The Protection of Personal Information Act
The Protection of Personal Information Act (“POPIA”) has been implemented and will become enforceable with effect from 1 July 2021.
POPIA regulates the processing of personal information. Personal information of both identifiable, living, natural persons (human beings) and of existing juristic persons (such as self-proprietor businesses and incorporated companies) is protected. Personal information includes, for example, information related to race, gender, age, physical or mental health, well-being, disability, contact details, medical history, biometric information and opinions about persons. Processing includes all actions that can be performed with personal information such as collection, receipt, recording, storage, usage, dissemination and erasure of that information.
